Terms & Conditions Biz Buddies

Thank you for your interest in the Biz Buddies for Start-ups (“the Program”). Nicol Heard t/a Courageous You and Biz Bestie (ABN 99 629 864 613) (“CY”, “me”, “I”) provide professional support and coaching services to business owners.  These are the terms upon which the Program is offered to you by Courageous You.  These Terms and Conditions should be read together with Courageous You’s Privacy Policy:  https://www.courageousu.com.au/privacy-policy/

Acceptance

By enrolling in the Program you are indicating your acceptance of these terms and conditions.  They will commence upon your acceptance and continue until termination occurs.  You will be provided with 30 days written notice of any changes that are made to these terms.  Your continued enrolment in the Program will indicate your acceptance of the amended terms.

The Program

You are enrolling in an ongoing program which is accessible to you for as long as it is offered by CY.  This is an online program, and face to face interaction is excluded.  Support outside of the Program is only provided in certain packages so make sure you purchase the service that suits your needs. The Program includes:

  • The opportunity to co-work with other members for 3 hours per month via Zoom at a time fixed by CY; and
  • A mastermind session with CY for 90 minutes per month.

You are also entitled to be offered free access to webinars and/or other resources made available by CY from time to time.

Collaboration

Your level of participation in the Program is up to you.  However, to gain the maximum benefit from the Program, you will need to be open to new ideas and implementing new tools in your business and in your life.  Your experience in the Program depends upon your involvement and willingness to participate.

Group Interaction

Where the Program involves group interaction you agree that:

  • You will always treat other members respectfully ;
  • You will not upload or provide content to any platform managed by Courageous You, or to any member of the Program which is:

(a)    defamatory, fraudulent, unlawful, threatening, intimidating, harassing, disrespectful, inappropriate, harmful, hateful, abusive, tortious, obscene, invasive of another’s privacy, sexist, racist, homophobic, violent or degrading;

(b)    infringes the intellectual or other proprietary interests of third parties;

(c)    contains spam, chain letters, pyramid and other such selling and marketing schemes, computer viruses, harmful code files or programs or any other information which in any way impinges on another Member’s use or enjoyment of the Program or otherwise breaches or encourages other users to breach these Terms and Conditions;

(d)    violates any law; or

(e)    encourages or incites any other person to engage in any of the above behaviour.

If Courageous You has reason to believe that you have engaged in any of the above behaviour, Courageous You has the right to immediately terminate your enrolment in the Program.

Questions or concerns

All questions or concerns about the Program and your experience with the Program, should be made to Nicole Heard in writing to nicol@courageousu.com.au.  You agree to first discuss any concerns in private with Nicol and that you will not express your concerns in a public forum, including to any other members enrolled in the Program.

Fees and Payment

When enrolling in the Program you agree to pay the monthly fee advertised.  The fee is payable upon enrolment and then monthly thereafter.  By subscribing to the Program, you are agreeing to CY deducting the subscription fee each month from your nominated credit card account.  Failure to pay the monthly fee on the date payable may result in your suspension from the Program until your payment is received.

Cancellation Policy

You can cancel your enrolment at any time by notifying Courageous You in writing to nicol@courageousu.com.au.  I require 48 hours’ notice before the end of your current subscription period in order to cancel your next month’s subscription payment.  You will have access to the program until the end of the current months subscription, and the next month’s subscription payment will not be deducted you’re your account.  Refunds will be provided in accordance with my obligations under the Australian Consumer Law.  CY will provide you with three months’ prior notice if the Program will be discontinued.

Confidentiality 

You to keep all information you receive from or about others during the Program confidential to you and to not disclose that information to any third party.  You also agree to not use any information obtained from or about others, or their businesses, in any way at all including but not limited to your own benefit.

Intellectual Property

Courageous You owns or has the legal right to use all information provided to you through the Program (“Program Materials”).  Courageous You hereby grants you a non-exclusive licence to use the Program Materials for your personal use only for the purpose for which it was provided to you. This licence expressly prohibits you from using the Program Materials for any commercial purposes.  You may only use the Program Materials for your personal use and may not do anything else with them including, sell, edit, reproduce or copy the Program Materials.

Health Disclaimer

Courageous You may suggest life style changes, such as implementing mindfulness practices.  Clients must inform Courageous You if you are taking any mood-altering medication, or other such medication, or if you suffer from any condition that may impact upon your emotional and mental health.  Courageous You is not a health services provider, and you should always consult with a specialist before making changes that impact your health.

Limitation of Liability

To the fullest extent permitted by law, the Licensor excludes all liability for indirect or consequential loss including loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind arising from your participation in the Program.

Neither you or Courageous You is liable for the non-performance of an obligation under these terms where the failure to perform arises due to a factor outside of the party’s control, on the condition that the affected party notify the other party of the reason for the failure as soon as practicable after the failure arises.  If the failure continues for 30 days, either party can terminate these terms and conditions immediately by providing written notice to the other party.

Warranties and Indemnitees

Courageous You does not warrant that the platforms which are used to provide the Program will be uninterrupted or error free.  Courageous You does not warrant against third party interference with online Platforms or that they will be compatible with third party software or hardware.

Courageous You provides guidance and tools for you to use in life and in business.  Courageous You does not guarantee any specific outcome or result in the Program.  Courageous You makes not warranties that the Program will increase the income generated by you, or any other warranties about the effect of the Program on the success of your business.

Termination

These terms and conditions will terminate automatically upon your completion of the Program.  However, the clauses relating to “Confidentiality”, “Intellectual Property”, “Limitation of Liability”, and “Warranties and Indemnitees” remain in force.

Legal

This agreement is governed by the laws of Victoria, Australia and the parties agree to the exclusive jurisdiction of the Victorian Courts.  If any term of this agreement is found invalid or unenforceable it is to be read down to the extent possible or severed to the extent of the invalidity or unenforceability but the rest of the agreement remains in force.
